Director ID Number Update
27 April 2022
In this second update, Jon Broadley, Director of Commercial Dispute Resolution Services, and a Founding Partner of member firm Broadley Rees Hogan Lawyers in Brisbane summarises the new corporate requirements in Australia.
This article is an update to a previous post Jon summarised in November 2021 regarding the new corporate requirements in Australia.
If you became a director on or before 31 October 2021, you must apply for your Director ID number by 30 November 2022.
5 April 2022 marks the end of the current transitional period during which many directors must obtain their Director ID.
From now on, directors must apply for a Director ID number before they are appointed as a director.
Failure to obtain a Director ID number prior to being appointed a director, or within the required period for existing directors, is a strict liability offence. Fines are as high as $13,200.00 and may be imposed for the criminal offence, and up to $1,100,000.00 if the Court considers it appropriate to apply a civil penalty.
For those directors who do not have access to the internet, or are overseas, they can apply for the Director ID by phone or by paper form.
